Is P2P Downloading Legal in Canada (Part II)

June 22nd, 2005 Posted in Web-based Services

Michael Geist takes a stab at figuring out whether proposed amendments to Canada's copyrights laws will allow for legal downloading using P2P networks. It's somewhat complicated but the fact the proposed amendments address uploading rather than downloading leads one to believe some downloading will still legal. The key will be determining what kind of downloading is permitted. Geist concludes that after Bill C-60 is implemented, the downloading question will likely be determined by the Supreme Court of Canada rather than copyright legislation. Looks like lawyers for the music labels can look forward to many more billable hours.
